  1. How does your firm charge for services?

Our fee structure depends on the type of case. For personal injury cases we often work on a contingency fee basis, meaning you don’t pay unless we recover compensation for you. For vaccine injuries, the Program pays for reasonable attorneys’ costs and fees separately from any compensation award. Therefore, unlike a regular personal injury case, the attorneys are not paid a percentage of your recovery. In addition, our firm, as a service to our clients, covers the up-front costs of litigating the case such as filing fees, expert witness fees, costs to obtain medical records, travel expenses, etc. This means that you pay nothing to be represented by an experienced persona injury and vaccine injury lawyer.  For other services, such as real estate transactions, we offer competitive rates. Please contact us to discuss the specifics of your case.

  1. Are your attorneys recognized for their work?

Yes, our attorneys have been named to Super Lawyers’ New York State Rising Stars List, New York State Super Lawyers List, and have been recognized by publications such as U.S. News and World Report for excellence in the practice of law.

  1. What is the National Vaccine Injury Compensation Program (NVICP)?

The NVICP is a federal program established to compensate individuals who have been injured by certain vaccines. It serves as an alternative to traditional legal proceedings, allowing claimants to seek compensation without the need to prove negligence.

  1. Do I need a lawyer to file a claim with the NVICP?

While it’s not mandatory to have legal representation when filing a claim with the NVICP (unless the claimant is a minor or legally incapacitated), it is strongly recommended. The process can be complex, involving intricate legal and medical issues. Importantly, hiring a vaccine injury attorney comes at no cost to you, as the NVICP covers all legal fees and costs.

  1. What types of vaccine injuries are eligible for compensation?

The NVICP covers a range of vaccine-related injuries, including but not limited to:

  • Shoulder Injuries Related to Vaccine Administration (SIRVA)
  • Guillain-Barré Syndrome (GBS)
  • Anaphylaxis
  • Chronic Regional Pain Syndrome (CRPS)
  • Brachial Neuritis
  • Transverse Myelitis
  • Encephalopathy or encephalitis
  • Acute Disseminated Encephalomyelitis (ADEM)
  • For a comprehensive list and more details, please visit our Vaccine Injuries page.

  1. How long do I have to file a vaccine injury claim?

Generally, you must file a claim with the NVICP within three years from the date of the first symptom or manifestation of the injury. In order to be safe, our firm generally recommends filing a petition within 3 years of the date the vaccine was administered. If the injury resulted in death, the claim must be filed within two years of the death and within four years of the date of the first symptom or manifestation of the injury that caused the death.

  1. What are some examples of medical diagnoses that result from a SIRVA injury?

Some common medical diagnoses that can result from a SIRVA injury include adhesive capsulitis (frozen shoulder), bursitis, tendinitis/tendinopathy, Shoulder Impingement Syndrome, Glenohumeral Joint Synovitis, and a rotator cuff tear or injury.

  1. Can I file a claim if I live outside of Buffalo, NY?

Yes, vaccine injury claims are filed with the U.S. Court of Federal Claims in Washington, D.C., and are not location-dependent. Our firm can represent clients nationwide and will travel to you for any necessary hearings or meetings.
